Senator Cramer Introduces Bill that Would Ban Banks from Refusing Service to Certain Industries

U.S. Sen. Kevin Cramer (R-ND) introduced legislation prohibiting financial institutions from refusing or limiting services to certain industries, such as fossil fuels. The bill, the Fair Access to Banking Act, would require banks to base judgments and decisions on impartial, individualized risk-based analysis developed through empirical data and evaluated under quantifiable standards. This bill is endorsed by the National Association of Wholesaler-Distributors.

Department of Labor Proposes New Independent Contractor Rule

On October 13, the Department of Labor (DOL) published a notice of proposed rulemaking advising that it intends to alter the test used to distinguish independent contractors from employees under the Fair Labor Standards Act (FLSA). The proposed rule will rescind the 2021 Independent Contractor Rule and replace it with a multifactor, totality-of-the-circumstances test that will likely cause an increase in the number of workers classified as independent contractors.

NAW Supports the American Innovation and Choice Online Act

On September 13, the National Association of Wholesaler-Distributors announced its support of bipartisan Senate bill 2992, the American Innovation and Choice Online Act introduced by Senators Amy Klobuchar (D-Minnesota) and Chuck Grassley (R-Iowa). In its new public affairs campaign, NAW is urging Congress to “level the playing field” between “big tech companies like Amazon who have limited consumer choice online.”
