IRS Energy Tax Credit Update

IRS Energy Tax Credit Rule - In December, WMA submitted public comments opposing a proposed IRS rule requiring item-specific product identification numbers (PINs) on energy tax credit-eligible windows, doors, and skylights. WMA also attended the IRS public hearing in Washington, D.C., advocating for an alternative approach using the existing NFRC Certified Products Directory (CPD) number rather than adding unnecessary complexity. WMA argued that the proposed regulations are redundant, burdensome for manufacturers, and could discourage consumer participation in the tax credit program. Alternatively, WMA requested a one-year postponement of implementation to allow time for the IRS Energy Credits Online Portal to become operational.

OSHA’s Proposed Heat Standard - On January 14, 2025, the Coalition for Workplace Safety (CWS) submitted written comments to the Occupational Safety and Health Administration’s (OSHA’s) proposed standard for Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings. WMA signed onto these comments along with 63 other trade groups and associations, in agreement with the significant concerns expressed by the CWS and the coalition’s request that the proposed rule be withdrawn, revisited, and modified to create a more flexible approach that will allow employers to tailor heat illness prevention programs based on their unique work environments, employees’ needs, and tolerances.

 

With President Trump’s regulatory freeze now in effect, both of these proposed rules are likely delayed and may not move forward. WMA will continue monitoring developments and keep members informed.
