U.S. DOL Issues Guidance on FMLA Implications of Telemedicine Visits and Electronic Notices of Statutory Rights

The U.S. Department of Labor’s (DOL) Wage and Hour Division (WHD) issued two guidance memos aimed at addressing several pandemic-related compliance challenges faced by employers. The first memo discusses when the WHD will consider electronic notices sufficient to satisfy the posting requirements under several statutes, including the Fair Labor Standards Act and the Family Medical Leave Act (FMLA). The second memo sets forth the requirements for a telemedicine appointment to qualify as an “in-person” visit for purposes of establishing a serious health condition under FLMA.

Trump Signs Stimulus Bill; ‘PPP Second Draw’ Provides a Shot in the Arm for Small Business Owners

President Trump signed into law a $900 billion stimulus package that renews the Paycheck Protection Program (PPP) with a so-called “PPP Second Draw,” intended to provide loans with a maximum amount of $2 million to smaller and harder-hit businesses that previously applied for and received PPP funding.
