OSHA Enforcement Policy for Respiratory Hazards Not Covered by Permissible Exposure Limits (PELs)

OSHA has issued a memorandum that clarifies its existing policy for developing citations under section 5(a)(1) of the Occupational Safety and Health Act (also known as the general duty clause) for respiratory hazards from exposure to an air contaminant that is not covered by an OSHA permissible exposure limit (PEL).

The following elements must be established for OSHA to prove a violation of the general duty clause:

  1. The employer failed to keep the workplace free of a hazard to which employees of that employer were exposed;
  2. The hazard was recognized;
  3. The hazard was causing or was likely to cause death or serious physical harm; and,
  4. There was a feasible and useful method to correct the hazard.

The memorandum states that unless the case file evidence proves all four of the above elements, the OSHA Area Office should issue a hazard alert letter (HAL) instead of a citation.  If there is sufficient proof of the four elements, the Area Office should issue a citation for a general duty clause violation.  The memorandum provides additional guidance for developing evidence for each of the four general duty clause elements when specifically applied to respiratory hazards.

CALIFORNIA GIVES FINAL APPROVAL TO 2020 SOLAR PANEL MANDATE: The new requirement will cost about $10,000 per home

“It’s officially official,” says Kelly Knutsen, director of technology advancement for the California Solar & Storage Association, referring to the California Building Standards Commission’s (CBSC) unanimous vote to confirm the solar panel mandate on new homes in California, starting in 2020.  With the newly established code, California is the first state in the country to adopt the clean energy requirement.  Low-rise residential buildings, including single-family homes and multifamily dwellings of three stories or less, are required to use solar for new permits dating Jan. 1, 2020, or later.

JELD-WEN Ordered to Divest Illegally Acquired Plant to Restore Competition; Federal Court Enters Judgment for Steves & Sons in Landmark Antitrust Battle

SAN ANTONIO – (December 14, 2018)  In a sweeping final judgment order, Federal Judge Robert E. Payne today ordered JELD-WEN, Inc., a wholly-owned subsidiary of JELD-WEN Holding, Inc. (NYSE:JELD) to divest itself of its Towanda, Pennsylvania, interior molded doorskin-manufacturing plant, to preserve and maintain the plant – in all aspects — through divestiture to another company, and to enter a series of contracts designed to ensure that the divestiture results in a viable supplier of molded doorskins going forward.

Staying Safe During Equipment Maintenance

Lockout/tagout, known as LOTO, is the concept of controlling hazardous energy, usually in order to service or perform maintenance on machinery. Planning the work, identifying all energy sources to be controlled and the means for verifying disconnection, training employees and supervisors on the procedures to follow to ensure they work safely, and providing the necessary devices and equipment—locks, tags, etc.—should be addressed in the employer’s written LOTO plan for carrying out the work.

 

Appendix A of OSHA’s 1910.147 lockout standard offers a simple lockout procedure that the agency says could benefit employers as they develop their procedures, so that they’ll meet the standard’s requirements.

Oregon Adopts Alternative Code for Energy Efficiency

(November 29, 2018) This week, the Oregon Zero Code Efficiency Standard was approved by the Building Codes Structures Board and adopted by the Building Codes Division for use throughout Oregon.  The code is based on nationally developed standards and establishes a predictable and efficient path for achievable energy-efficiency improvements.  Adopting fully vetted, cost-effective, and federally recognized standards provides Oregon businesses with predictability and creates a more efficient regulatory framework.

Harvard’s Housezero is a Living Lab for Sustainable Design

The Harvard Center for Green Buildings and Cities (CGBC) at the Harvard Graduate School of Design (GSD) has completed an ambitious effort to retrofit a 1924 home in Cambridge into a living laboratory that will serve as the organization’s headquarters. Dubbed HouseZero, the energy-positive prototype for ultra-efficient architecture aims to demonstrate how existing structures can be modified to consume less energy.

Research Finds Fire-Resistant Building Codes Do Not Raise Home Prices

Homes in wildfire-prone areas around the U.S. could be built to better withstand blazes without increasing the cost of construction, according to a new report.  The research released Tuesday was sponsored in part by the insurance industry and marks the first attempt to quantify the expenses associated with building residences that meet stringent flame-resistant criteria. Few states have adopted such codes, often citing housing costs, but the new findings suggest fire-plagued communities could curb damage and save lives with minimal effect on home buyers.
